Terms of Use
These Terms of Use govern access to and use of the TopShape platform — the student app (iOS and Android), the personal trainer's web portal, and the topshapeapp.com website. By creating an account or using TopShape, you agree to these terms. If you do not agree, do not use the platform.
1. What TopShape is
TopShape is a management platform for personal trainers and their clients. The trainer adds clients, builds workouts, sets up periodic check-ins, and tracks each client's progress from the web portal. The client receives access to their account (created by the trainer) and trains through the app, logging sets, loads, cardio sessions, and check-ins.
2. Accounts and eligibility
- Client accounts are created by the responsible personal trainer, not by the client themselves.
- Use of the platform is intended for users 13 years of age or older. If you are the legal guardian of a minor client, the signup assumes your consent.
- You're responsible for keeping your account credentials confidential and for all activity under your account.
- Registration information must be accurate and kept up to date.
3. Plans and payment
- Free plan — free, permanent, no credit card required. Limited to up to 3 clients and 5 workouts per client.
- Pro plan — paid subscription (R$29.90/month in Brazil or $14.90/month in USD), with unlimited clients and workouts, reusable global workout templates, and payment tracking. Billed on a recurring basis until cancelled.
- The trainer's subscription payment is processed by Stripe. TopShape does not store card data.
- You can cancel your Pro subscription at any time; Pro access remains active until the end of the already-paid billing cycle, with no prorated refund for the current period, except where required by law.
- We may change plan pricing with reasonable advance notice, published on the site or communicated by email.
- The "payment management" feature inside TopShape is a tracking/record-keeping tool for fees agreed upon between trainer and client directly — it is not an automatic billing gateway, and TopShape does not process or intermediate payments between trainer and client.
4. Acceptable use
By using TopShape, you agree not to:
- Use the platform for illegal or unauthorized purposes;
- Attempt to access accounts, data, or areas of the system without authorization;
- Reverse-engineer, decompile, or attempt to extract the platform's source code;
- Overload, disrupt, or compromise the service's infrastructure or security;
- Submit offensive, illegal content, or content that violates third-party rights through chat or any other feature.
5. User content
You retain ownership of the data and content you submit to the platform (check-in photos, messages, workout data). By submitting this content, you grant TopShape a limited license to store, process, and display it only as needed to operate the service — including making a client's workout data visible to their responsible trainer, and vice versa. Check-in photos are kept in private storage, accessible only via signed, temporary URLs. See more detail in our Privacy Policy.
6. Intellectual property
TopShape, its brand, visual identity, software, and exercise library are owned by TopShape and its licensors, protected by intellectual property laws. These Terms do not grant you any rights to the brand or software beyond what's necessary to use the platform as intended.
7. Health and exercise notice
TopShape is a workout management and tracking tool — it does not replace medical, nutritional, or professional exercise guidance. Workout information and recommendations entered into the platform are the responsibility of the personal trainer who creates them. Consult a healthcare professional before starting any exercise program, especially if you have pre-existing medical conditions.
8. Disclaimer of warranties and limitation of liability
TopShape is provided "as is," with no guarantee that the service will be uninterrupted or error-free. To the maximum extent permitted by law, TopShape is not liable for indirect, incidental, or consequential damages arising from use or inability to use the platform, including injuries related to exercises logged or prescribed by third parties through the platform.
9. Suspension and termination
We may suspend or terminate access for an account that violates these Terms. You may terminate your account at any time by contacting us; your data will be handled as described in the Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the site or app, with the effective date updated at the top of this page. Continued use of the platform after an update constitutes acceptance of the new terms.
11. Governing law
These Terms are governed by the laws of Brazil. Any disputes will be submitted to the jurisdiction of TopShape's domicile, unless otherwise required by applicable law.
